These Terms of Use ("Terms") govern your use of www.kwiinkulture.com (the "Site"), operated by Kwiin Kulture, LLC ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site is an informational website showcasing the work of creator Kwiin Ava, including the Star Puff® brand services, the Star Puff® series, the Avé Avant-Garde children's character, an art gallery, and wholesale information for the book Avé Avant-Garde Presents: ABC's of Natural Hair. The Site does not currently offer online retail sales. If we add an online store in the future, purchases will be governed by additional terms presented at checkout (including pricing, shipping, and return policies).

2. Eligibility

You must be at least 13 years old to use the Site. Children under 13 should use the Site only with a parent or guardian. Our partnership inquiry form is intended for adults (age 18 or older) acting as business representatives.

3. Intellectual Property

All content on the Site - including text, images, artwork, videos, logos, and the Star Puff® and related puff-sculpture designs and names - is owned by the operators of this site and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, personal, non-commercial license to view the Site. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except as permitted by law (such as fair use).

Copyright complaints (DMCA)

If you believe content on the Site infringes your copyright, please send a notice including (a) identification of the copyrighted work, (b) identification of the allegedly infringing material and its location on the Site, and (c) your contact information and a statement made under penalty of perjury, using the contact us form.

4. Partnership Inquiries

Submitting a partnership inquiry form does not create a partnership, agency, endorsement, or business relationship. We are under no obligation to respond to or accept any inquiry. Any partnership that results will be governed by a separate written agreement.

5. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;

  • Attempt to gain unauthorized access to the Site, its servers, or related systems;

  • Scrape, harvest, or collect information from the Site by automated means without our permission;

  • Impersonate us, Kwiin Ava, or any other person or entity;

  • Interfere with the proper functioning of the Site.

6. Wholesale Inquiries

Information about wholesale availability of our products (including the ABC's of Natural Hair book) is provided for informational purposes. Product availability, pricing, minimum order quantities, and fulfillment terms are confirmed in writing on a case-by-case basis and are not guaranteed by anything stated on the Site.

The Site links to third-party websites and social media platforms (including Instagram, Facebook, TikTok, YouTube, and X). We do not control and are not responsible for the content, products, or practices of third-party sites.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE WILL NOT EXCEED $100.

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site.

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction.

We may update these Terms from time to time (for example, when we launch online retail). We will update the "Last updated" date above, and your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms constitute the entire agreement between you and us regarding the Site.
